Program Status and Timeline (PDF)

In August 2009, Governor Bill Ritter announced a budget balancing plan to close a $318 million revenue shortfall in the current 2009-10 state budget. As part of this budget balancing plan, the Energy and Mineral Impact Assistance Fund (EIAF) program will be impacted through the transfer of $7.6 million from the program to the General Fund as well as suspending the award of $25 million in grants until January 31, 2010.

All applications that had been received by the August 1, 2009, deadline will be held for consideration until the next available grant cycle after January 31, 2010.

No supplemental funding is available for existing contracts at this time.

Overview:
The purpose of the Energy and Mineral Impact Assistance Program is to assist political subdivisions that are socially and/or economically impacted by the development, processing, or energy conversion of minerals and mineral fuels. Funds come from the state severance tax on energy and mineral production and from a portion of the state's share of royalties paid to the federal government for mining and drilling of minerals and mineral fuels on federally-owned land. The program was created by the legislature in 1977.

The department is assisted by a twelve-member Energy and Mineral Impact Assistance Advisory Committee, which meets several times each year, to consider applications for grants and low-interest loans. Seven members are appointed by the Governor to four-year terms, while the remaining five are state department executive directors or their designees. Final funding decisions are made by the department's executive director.

Eligible entities to receive grants and loans include municipalities, counties, school districts, special districts and other political subdivisions and state agencies. The kinds of projects that are funded include -- but are not limited to -- water and sewer improvements, road improvements, construction/improvements to recreation centers, senior centers and other public facilities, fire protection buildings and equipment, and local government planning.

Modifications to the program include categorizing grants into Tier I, Tier II and Tier III and clarifying evaluation criteria, including match requirements.

Tier I
~ Effective August 1, 2008 ~

These grant funds can be used for a variety of public purposes including planning, engineering and design studies, and capital projects requiring a limited level of financial assistance.

  • Grant awards up to $200,000.
  • Applications for grant consideration will be expected to include a minimum match of 25%. Larger matching amounts are generally more competitive.
  • Applications will be reviewed and recommended for funding by Department of Local Affairs staff. The Executive Director will make funding decisions three times per year.

Tier II
~ Effective August 1, 2008 ~

This grant program is intended to support a wide variety of community development projects to improve quality of life in communities.

  • Grant awards greater than $200,000 up to $2,000,000.
  • Applications for grant consideration will be expected to include a minimum match of 25%. Larger matching amounts are generally more competitive.
  • Applications for this program will be reviewed by the Advisory Committee, and the Executive Director will make funding decisions three times per year.

Tier III
~ Expected Implementation - TBA ~

This grant program is to help political subdivisions with regional or multi-jurisdictional projects intended to mitigate major impacts associated with energy/mineral industries (dependent upon revenue availability).

  • One cycle per year
  • Multi-million dollar, multi-year projects ($2 million up to $10 million in size)
  • Expect regional/multi-jurisdictional focus
